These Terms of Service govern your access to and use of schreackecustomstamping.com and your purchase of products from Schreacke Custom Stamping LLC.

Throughout these Terms, “Schreacke Custom Stamping,” “we,” “us,” and “our” refer to Schreacke Custom Stamping LLC. “You” and “your” refer to the website visitor, customer, or person submitting an order.

By accessing our website, placing an order, or otherwise using our services, you agree to these Terms and our related policies. If you do not agree, do not use the website or place an order.

  1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to place an order. If you place an order for a company or another person, you represent that you have authority to act on their behalf.

You are responsible for providing accurate account, payment, customization, contact, and shipping information.

  1. Online store

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell products and services to you. Certain payment, account, checkout, analytics, and technical functions may be provided by Shopify or other service providers.

Use of personal information is governed by our Privacy Policy.

  1. Product information

We make reasonable efforts to display product descriptions, sizes, colors, photographs, prices, and availability accurately. However:

  • Screen displays may not represent ink colors exactly

  • Product dimensions may have small manufacturing tolerances

  • Stamp impressions can vary depending on paper, pressure, surface, ink coverage, and use

  • Product photographs may include examples, props, or designs not included with the purchase

The approved proof, product selection, and order confirmation together define the principal specifications of a custom order.

  1. Custom orders

Our products are made using customer-submitted text, instructions, artwork, logos, signatures, documents, or other content.

You are responsible for reviewing all submitted information for accuracy, including spelling, punctuation, capitalization, dates, numbers, addresses, and names.

Submitting an order does not guarantee that every design can be manufactured exactly as submitted. We may recommend changes to improve legibility, fit, or manufacturability. Material changes will be presented in the proof before production.

  1. Proofs and approval

We normally send a digital proof before production. You must review the complete proof, not only the text, before approving it.

Approval confirms that you accept:

  • Spelling, punctuation, capitalization, and wording

  • Artwork and logo selection

  • General layout, orientation, and alignment

  • Approximate artwork size and proportions

  • Stamp size and ink color

  • Any disclosed limitations or adjustments

Customers have three business days after a proof is sent to approve it or request changes. If we do not receive a response during that period, we may treat the proof as approved and begin production.

  1. Prices and payment

Prices are shown in United States dollars unless otherwise stated. Applicable taxes, shipping charges, and available shipping methods are displayed during checkout.

Payment is due when the order is placed. By submitting payment information, you represent that you are authorized to use the selected payment method.

We may correct an obvious pricing or listing error. If an error affects an order already placed, we will contact you before proceeding and give you the choice to accept the corrected terms or cancel for a refund.

  1. Order acceptance

An order confirmation acknowledges that we received your order. It does not require us to produce content that is unlawful, infringing, fraudulent, threatening, hateful, exploitative, technically unsafe, or otherwise inappropriate for production.

We may refuse or cancel an order for a legitimate business, legal, fraud-prevention, safety, or technical reason. If we cancel an order before production, we will refund the amount paid for the cancelled item.

  1. Changes and cancellations

You may request changes before approving the proof. Reasonable revisions that remain within the original order instructions are generally included.

A substantially different design, additional design work, or a change in stamp size or product may require a new order or additional payment. We will disclose any additional charge before proceeding.

Orders may be cancelled for a full refund until production begins. Once a proof is approved—or treated as approved after the review period—and production begins, the order cannot normally be changed or cancelled.

  1. Shipping and delivery

Production and delivery timeframes are described in our Shipping Policy.

Delivery dates are estimates unless we expressly agree in writing to a guaranteed date. Customers are responsible for supplying an accurate and deliverable shipping address.

Risk of physical loss transfers as permitted by applicable law. If a shipment is lost or damaged in transit, contact us so that we can investigate and provide an appropriate resolution.

  1. Returns, defects, and refunds

Because our products are personalized, they are generally final sale after production begins.

We will address products that arrive damaged, are defective, are incorrect, or materially differ from the approved proof. Eligibility, reporting deadlines, remedies, and refund processing are described in our Return and Refund Policy.

Nothing in these Terms limits a non-waivable consumer right or remedy provided by applicable law.

  1. Customer content and intellectual-property rights

You retain your ownership rights in the text, artwork, logos, signatures, documents, and other content you submit.

By submitting content, you give us a limited, nonexclusive license to access, copy, modify, format, reproduce, and use that content as reasonably necessary to:

  • Communicate with you

  • Prepare proofs

  • Manufacture and deliver your order

  • Provide customer service

  • Maintain legally or operationally necessary order records

We will not use a customer’s custom artwork in public advertising, a portfolio, or social media without permission.

You represent that you own the submitted content or have sufficient permission to reproduce it. You must not submit content that infringes another person’s trademark, copyright, privacy, publicity, or other rights.

You are responsible for claims resulting from content you submitted without the necessary rights or authorization.

  1. Our intellectual property

The website and its original content—including our business name, branding, photographs, graphics, page designs, written content, and software customizations—are owned by or licensed to Schreacke Custom Stamping.

You may not copy, reproduce, republish, sell, distribute, scrape, or commercially exploit our website content without written permission, except as allowed by law.

  1. Prohibited uses

You may not use the website or services to:

  • Violate any applicable law

  • Commit fraud or impersonate another person

  • Infringe intellectual-property or privacy rights

  • Transmit malware or harmful code

  • Interfere with website security or operation

  • Attempt unauthorized access to an account or system

  • Collect information about other users without authorization

  • Submit illegal or exploitative content

  • Use automated systems in a manner that unreasonably burdens the website

We may suspend access, reject an order, or take other reasonable action when these restrictions are violated.

  1. Third-party services and links

Our website may contain services, applications, or links provided by third parties. We do not control every third-party website or service and are not responsible for its independent content, availability, security, or privacy practices.

Your use of a third-party service may be governed by that provider’s terms.

  1. Website availability

We try to keep the website accurate, secure, and available, but we do not guarantee uninterrupted or error-free operation. We may update, suspend, restrict, or discontinue a website feature when reasonably necessary.

  1. Disclaimer of warranties

To the maximum extent permitted by law, the website and online services are provided on an “as available” basis.

We do not disclaim any express product promise contained in an order confirmation, approved proof, or published policy. We also do not exclude warranties or consumer rights that cannot legally be excluded.

  1. Limitation of liability

To the maximum extent permitted by law, Schreacke Custom Stamping will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or purchase of a product.

For a claim arising from a particular order, our aggregate liability will not exceed the amount paid for that order, except where a greater remedy is required by law.

These limitations do not apply to liability that cannot legally be limited, or to our fraud, willful misconduct, or gross negligence.

  1. Indemnification

To the extent permitted by law, you agree to reimburse Schreacke Custom Stamping for reasonable losses, liabilities, and expenses resulting from:

  • Content you submitted without required ownership or permission

  • Your unlawful or fraudulent conduct

  • Your material violation of these Terms

This provision does not require you to indemnify us for our own wrongful conduct.

  1. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where the mandatory consumer laws of another jurisdiction apply.

  1. Severability and waiver

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

  1. Changes to these Terms

We may update these Terms to reflect changes in our products, services, practices, or legal obligations. The revised Terms will be posted on this website with an updated revision date.

Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when an order was placed will generally govern that order.

  1. Entire agreement

These Terms, the order confirmation, approved proof, and policies referenced above constitute the agreement between you and Schreacke Custom Stamping regarding your order.

If an order-specific written promise conflicts with these general Terms, the order-specific promise controls for that order.
